Job Purpose:
The Senior Director, Assistant General Counsel is a senior, hands-on attorney who provides practical legal and compliance counsel across Pharmacosmos Therapeutics Inc. (PTI). Reporting to the VP, Head of Legal and Compliance, this individual will serve as a key member of a small, collaborative department and independently manage a broad portfolio of matters supporting the Company’s commercial, medical, market access and corporate functions.
This is a generalist role for an attorney who is equally comfortable advising on complex issues and personally handling detailed day-to-day execution. The Director, Assistant General Counsel will be expected to exercise sound judgment, adapt to changing business needs and help stakeholders achieve compliant business objectives.
Job Responsibilities:
- Serve as a senior legal and compliance advisor to PTI’s commercial, medical, market access and corporate functions, providing practical, business-oriented counsel on strategic and day-to-day matters.
- Independently structure, draft and negotiate complex commercial and research-related agreements, including clinical research, investigator-sponsored research, data use, healthcare professional, market access, distribution, vendor, consulting, confidentiality, sponsorship and grant-related agreements.
- Oversee and execute assigned elements of PTI’s compliance program, including review of proposed business activities, policy development, training, monitoring and auditing, investigations, remediation and corrective actions.
- Lead or support internal compliance and workplace investigations, including developing investigative plans, conducting interviews, assessing findings and advising on appropriate remediation.
- Provide legal review and counsel regarding promotional, medical and other external-facing activities and materials, including participation in applicable review committees.
- Advise on additional legal matters as needed, including employment, privacy, litigation, disputes, regulatory inquiries and cross-functional business initiatives.
- Independently manage assigned matters from intake through resolution, including directing outside counsel where appropriate, while escalating significant legal and compliance risks to the VP, Head of Legal and Compliance.
- Other Duties as assigned.
Education & Professional Background:
- At least 7 (seven) years of relevant legal experience, including meaningful in-house experience in the pharmaceutical or biotechnology industry.
- Juris Doctor degree from an accredited U.S. law school and an active license to practice law in good standing in at least one U.S. state, with the ability to secure a limited in-house license from the State of New Jersey within 90 days if not admitted in New Jersey.
- Working knowledge of laws and standards applicable to pharmaceutical manufacturers, including the Anti-Kickback Statute, False Claims Act, FDA promotional requirements, federal and state privacy laws, transparency requirements, anti-bribery laws and applicable industry codes.
- Broad legal and compliance experience in a regulated life-sciences environment, with demonstrated ability to work across multiple subject areas. Experience with pharmaceutical commercial contracting, healthcare compliance and market access matters strongly preferred. Experience supporting government pricing matters preferred, but not required.
- Ability to work independently, manage competing priorities and exercise sound judgment regarding when to escalate matters.
- High ethical standards and demonstrated discretion in handling sensitive and confidential information.
