The Cybersecurity & Data Privacy Practice Group of Constangy, Brooks, Smith & Prophete, LLP seeks a talented Associate attorney with 3–7 years of litigation experience to join our growing Cyber Litigation team. Experience handling complex commercial litigation, class action defense, or privacy and cybersecurity litigation is preferred. Substantial experience in privacy and data breach litigation is not required, but a demonstrated interest in developing a practice in this rapidly evolving area of law is highly desirable.
The ideal candidate will have a strong foundation in litigation, excellent research and writing skills, and experience managing substantive aspects of complex litigation matters.
This position offers the opportunity to work alongside experienced attorneys on sophisticated, high-profile matters for clients across a variety of industries, while gaining meaningful hands-on experience and opportunities for professional growth.
Key Responsibilities
- Assist in defending clients in privacy and data breach class actions, single-plaintiff privacy litigation, technology errors and omissions matters, and other complex commercial litigation.
- Conduct legal research and draft pleadings, motions, briefs, discovery requests and responses, and other substantive litigation documents.
- Participate in all phases of litigation, including discovery, depositions, hearings, mediations, and trial preparation.
- Analyze complex legal and factual issues involving privacy statutes, cybersecurity incidents, and emerging legal developments.
- Collaborate with partners, senior attorneys, and other team members to develop litigation strategies and achieve favorable client outcomes.
- Communicate effectively with clients, opposing counsel, and internal litigation teams.
- Stay informed of developments in privacy and cybersecurity law, including emerging litigation trends and regulatory changes.
Qualifications
- 3–7 years of litigation experience, preferably involving complex commercial litigation, class action defense, privacy litigation, or cybersecurity-related disputes.
- Strong legal research, writing, analytical, and oral advocacy skills.
- Experience with substantive motion practice, written discovery, and other aspects of litigation.
- Familiarity with federal and state privacy statutes, including CCPA/CPRA, BIPA, VPPA, and related laws, is preferred but not required.
- Excellent academic credentials and demonstrated professional achievement.
- Strong organizational skills, attention to detail, and the ability to manage multiple matters and competing deadlines.
- Ability to work both independently and collaboratively in a fast-paced, team-oriented environment.
- Juris Doctor (J.D.) from an accredited law school and active admission to practice law in at least one U.S. jurisdiction.
- Active admission to the California State Bar is preferred, but not required.
Remote work arrangements are available.
This position offers a competitive base salary range of $148,000–$217,000 nationwide. In addition to base compensation, Associates are eligible for additional performance-based incentives, including billable hour bonuses, providing opportunities to increase their total annual compensation.
Actual base compensation within this range will be determined by several factors, including geographic location, relevant experience, internal equity, skills, qualifications, and other job-related factors permitted by applicable law.
Only applicants who possess a Juris Doctor (J.D.) and are actively licensed to practice law in at least one U.S. jurisdiction will be considered. California Bar admission is preferred.
Candidate materials should be submitted online or directly to Nicholas Golden, National Recruiting Manager, at ngolden@constangy.com.
